ACEEM TENNIS TERMS AND CONDITIONS OF SERVICE 

All customers are required to accept these Terms and Conditions of Service prior to participation in any AceEm Tennis session(s). By signing up to an AceEm Tennis session you have agreed to the following terms and conditions. 

AceEm Tennis offers a range of lessons that vary in length. Details are outlined on our booking site under each class. 

Places are limited and are only reserved once booked and paid for in advance. If you are not sure which coaching session to join, please email us at tennis@aceem.co.nz  

TENNIS CLUB MEMBERSHIP

Current Tennis Club Membership at Orewa or Dairy Flat Tennis Clubs entitles you to member discounts on AceEm Tennis Coaching. If you are not a current Orewa or Dairy Flat Tennis Club Member you will be charged at the guest rate. If you do not inform us of any changes in your club membership status you may be charged the guest non-member fees retrospectively.

Dairy Flat Tennis Club Membership - now available to be purchased directly via the AceEm Tennis booking platform/player portal

CANCELLATION OF FLEXI MEMBERSHIP You may cancel your flexi membership by providing written notice reflective of the outlined commitment period detailed on purchase of your membership.

Cancellation becomes effective at the end of any remaining debit or commitment period. If you have arranged to prepay for a fixed term membership or term of coaching AceEm Tennis will not refund any pre-paid amounts for coaching and/or membership. If your cancellation is due to a medical reason, exemption requests to this policy must be made in writing and further information may be required.  Appeals will be considered on a case-by-case basis. Please note we may require a medical certificate.  

AceEm Tennis reserves the right to terminate your coaching and or membership immediately if you behave in any way that is seen as inappropriate. In this circumstance, AceEm Tennis will refund any remaining fees for that debit period.

UPFRONT ANNUAL MEMBERSHIP

No refunds or transfers are applicable to annual upfront memberships.

ACEEM COACHING AND FLEXI MEMBERSHIP PAYMENTS 

  • Payments are payable fortnightly in advance via direct debit from a transaction account or credit card. 

  • Payments are debited fortnightly on a Thursday.

  • In the event of a failed direct debit payment, such as insufficient funds, declined, expired credit card details or invalid payment information, we will implement a nominal failed payment fee of $10. If payment is not made, this could result in your lessons being canceled effective immediately. It is your responsibility to arrange an alternative method of payment so that bookings and/or membership can resume. You authorise AceEm Tennis to debit any outstanding fees from your transaction account or credit card. AceEm Tennis may engage a debt collection service to recover monies if debt remains outstanding. 

Transaction fees: 

  • Bank Account Transaction fee $0.90

  • Credit/Debit Card Transaction fee $0.44

  • Visa/MasterCard Service Fee 2.9%, American Express 3.85%

  • American Express Service Fee 3.85%

  • * Additional 1.15% will apply to International Credit Cards

PERPETUAL GROUP BOOKINGS

Once you are booked in: 

  • Your bookings will not end until you notify us with 14 days written notice to tennis@aceem.co.nz. 

  • Your spot on the booked sessions are secured until you cancel, move classes or the class you are in is discontinued due to coach/court availability etc. 

  • Most AceEm Tennis Classes run continuously throughout the year (Excluding Christmas & New Year. Please note your booking will roll over and continue in January unless you notify us otherwise). Holiday payment breaks will be given for classes that do not run during school holidays or on public holidays. 

UPFRONT PAYMENTS

Most AceEm classes booked under the ‘Tennis Classes’ section are perpetual bookings.

One off bookings and upfront membership payments must be paid at the time of purchase. This includes but is not limited to Tournaments, Cardio Tennis individual bookings and concessions, Social Events.

MAKEUP LESSONS

If you are unable to attend a lesson you are able to receive a make-up pass by logging in and marking yourself/child/children as absent no less than 1 hour before the lesson commences to receive a makeup pass. You are eligible for 1 make-up pass per school term (12 weeks).

  • Absences can be marked no more than 7 days in advance. 

  • Makeup passes can only be used after the class you have marked absent from has been missed. 

  • Your makeup pass has a 12 week expiry. 

  • Makeup lessons are subject to space availability. 

  • Makeup lessons can only be booked up to 3 days in advance. 

  • Refunds or credits are not provided as an alternative. 

  • Make-up lessons are not transferable to other students.  

Please note TopSpin Performance squads are eligible for x1 self cancellation refund per 12 weeks. This is due to there being no real opportunity for make-ups in other classes for these squad training sessions.

CANCELLATION OF COACHING You may cancel your ongoing coaching by providing 14 days written notice to tennis@aceem.co.nz

PRIVATE COACHING 

Cancellations at customers request.

Casual bookings:

A casual private lesson with any of our coaches is able to be canceled up to 24 hours prior to the lesson. Any cancellation with less than 24 hours' notice or a no show will incur a cancellation fee for the full cost of the lesson.

Perpetual bookings:

If you have secured your private coaching as a perpetual booking you are eligible for 1 make-up pass per term. You may cancel your booking up to 24 hours in advance and receive a make-up pass with a 12 week expiry. Any cancellation with less than 24 hours' notice or a no show may still be charged as normal to retain your regular session.

 DUE TO POOR WEATHER/COACH ILLNESS/UNFORESEEN CANCELLATION 

In the event of poor weather, or coach illness/inability to run a session AceEm Tennis will do its best to contact you via email at least 30 mins prior to the commencement of the session to advise if the session is canceled. Please be aware that with the changing nature of the weather this is not always possible and last minute or in session cancellation is a possibility. It is your responsibility to ensure your contact details/email are correct and up to date on your AceEm profile.  

  • As our coaches are often busy on court, it is likely they will be unable to respond to txt/phone calls/emails.

  • Decisions regarding lesson cancellations are at the sole discretion of the tennis coach or AceEm Tennis management. 

Group Lessons:

In the event of poor weather/unforeseen circumstances resulting in the cancellation of an outdoor group lesson, at the discretion of AceEm Tennis, an indoor session may run. These will focus on things like tactics, strategy, tennis rules, on court etiquette, fitness, stretching, warm-ups, resilience, fun indoor games. If the lesson is completely canceled by AceEm Tennis you will be issued a make-up pass with a 12 week expiry. Make-up passes can be used to book a make-up class online (subject to availability).

Private Lessons:

In the event of poor weather/coach illness/unforeseen circumstances resulting in the cancellation of a private session, we will arrange an alternative to make-up the lesson or if this is not possible, we will issue a make-up pass with a 12 week expiry. 

HEALTH AND SAFETY 

AceEm Tennis is fully committed to safeguarding the welfare of all people and players associated with us.  We follow all Tennis NZ, and relevant Tennis Club Health & Safety requirements.   

RESPONSIBILITY FOR MINORS BY PARENTS/GUARDIANS

You acknowledge that AceEm Tennis cannot supervise minors outside the court in which a session is taking place. Minors should be accompanied to their lesson and it is your responsibility to supervise them in the carpark and at any time they are off court or whilst outside of their lesson time.

INJURY 

You have voluntarily accepted and assumed the inherent risk or danger of injury in playing tennis and associated activities, and release AceEm Tennis from any liability due to injury. 

In the event of an accident or illness you authorise AceEm Tennis staff or contractors to act on your behalf according to their best judgment in any emergency requiring medical attention. Please ensure all contact details are correct and up to date on your AceEm profile. 

You declare yourself and/or your child is medically and physically fit and does not suffer from any injury, disease or condition, either physical or mental that would affect his or her ability to safely participate in any authorised or recognised activities run by AceEm Tennis. If you are unsure about this declaration, or your child does suffer from such a condition, you have listed it when registering with AceEm Tennis and are aware that you must bring it to the attention of AceEm Tennis immediately. 

You indemnify AceEm Tennis from all claims, losses and expenses (including legal costs) suffered or incurred at any time as a result of, or resulting directly or indirectly from, myself or my child’s failure to observe the rules, policies, guidelines and reasonable directions of AceEm Tennis staff members and contractors. 

PRIVACY

We work closely with the tennis clubs that we provide programs and coaching services to. To assist us with providing a great tennis experience for you we need to collect some personal information. When you provide this information you agree that we may share this information with the relevant tennis club. 

PHOTOGRAPHY AND SOCIAL MEDIA

When signing up for a coaching programme, you are granting us permission from time to time to; 

  • Use your details to send you AceEm Tennis news and updates.  

  • Take pictures or film of you or your child during coaching sessions, interclub, AceEm Tennis/club events. These may be used for promotional or marketing purposes on but not limited to club or coaching social media/websites.

  • If you have any concerns or would specifically not like any photos of you and/or your child(ren) to be used, please contact us directly and we will note this on your AceEm profile and ensure no photo's/videos are used without your direct permission.

PERSONAL PROPERTY

You are responsible for your own property. AceEm Tennis takes no responsibility for any property that is stolen, lost or damaged at the venues we provide services.

ACCURATE INFORMATION

Please ensure your details are kept up to date online such as postal address, email address, phone numbers and bank or credit card details.

DIRECT DEBIT AUTHORITY - (where applicable for ongoing bookings/flexi memberships).

I/We authorise and request Payrix Australia to debit payments from my/our account as specified on the Payrix Service Agreement. At intervals and amounts as directed by AceEm Tennis as per the Terms and Conditions of my agreement. I have read and agree to the AceEm Tennis Terms and Conditions and Payrix DDR Service Agreement
